Poker Central “Super High Roller” Sweepstakes Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.

A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS APPLY.

CRTV, LLC dba Poker Central (“Sponsor”) is pleased to introduce the Poker Central “Super High Roller” Sweepstakes (the “Sweepstakes”). As a condition of participating in the Sweepstakes, you agree to be fully and unconditionally bound by these Official Rules, which are a contract, and the decisions of Sponsor, whose decisions shall be final and binding in all respects, and to waive any right to claim ambiguity in the Sweepstakes, these Official Rules, and the Sweepstakes materials. Without limitation, this contract includes indemnities from you and a limitation of your rights and remedies. Winning and receiving a Grand Prize (defined in Section 7) is contingent upon fulfilling all requirements set forth herein.

  1. Facebook®, Google®, Twitter® and Disclaimer: 
    You agree and acknowledge, as condition of participating in the Sweepstakes, that Facebook Inc., Google Inc., Twitter, Inc., and their owners directors, officers, employees, contractors, agents, representatives, parents, subsidiaries, attorneys, insurers, and associated corporations and entities (collectively, the “Facebook/Google/Twitter Group”) are not sponsors of the Sweepstakes nor do they endorse or administer the Sweepstakes, nor do are they in any way associated with the Sweepstakes. All questions regarding the Sweepstakes must be directed to Sponsor, not the Facebook/Google/Twitter Group. You also agree that as a condition of participating in the Sweepstakes, you shall release the Facebook/Google/Twitter Group from any and all liability arising out of or relating to your entry, creation of an entry, submission of an entry, participation in the Sweepstakes, acceptance, use, or misuse of any Grand Prize, or the broadcast, exploitation, or use of an entry.
  2. Entry Period: 
    The Sweepstakes begins on January 1, 2015, at 12:00:00 p.m. Eastern Time (“ET”) and ends on May 15, 2015, at 11:59:59 p.m. ET (the “Sweepstakes Period”). The deadline to enter the Sweepstakes is May 15, 2015, at 11:59:59 p.m. ET. Eastern Time shall control for all purposes of the Sweepstakes. Sponsor’s computer shall be the official clock for purposes of the Sweepstakes.
  3. Eligibility: Sweepstakes is open to natural persons who are permanent legal residents of one (1) of the fifty (50) United States (including the District of Columbia) who are physically located and residing therein and who are at least twenty-one (21) years of age or older. Sponsor reserves the right to verify the eligibility of any entrant. The Sweepstakes is subject to applicable federal, state, provincial, municipal, territorial, and local laws and regulations and is VOID WHERE PROHIBITED OR RESTRICTED BY LAW.Directors, officers, employees, contractors, agents, representatives, owners, and members of Sponsor and its respective parent companies, affiliates, subsidiaries, franchisees, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, web site providers, web masters, and any and all other companies associated with the design or execution of the Sweepstakes, as well as their immediate family and household members, whether related or not, are not eligible to enter the Sweepstakes. “Immediate family” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. “Household members” shall mean those people who share the same residence.
  4. How to Enter: No purchase necessary to enter. You may enter the Sweepstakes by any one (1) of the following methods:
    • 4.1. Facebook Method of Entry
      During the Sweepstakes Period, visit the Poker Central Facebook page at http://www.facebook.com/PokerCentral.Complete the Poker Central “Super High Roller” Sweepstakes entry form, which requires the following information and affirmative actions from each entrant:

      • Preferred email address for contact and notification purposes;
      • First and last name;
      • Zip code;
      • Selecting all of the providers where you watch television/digitation content from the checklist provided;
      • Checking the box to verify that the entrant is at least twenty-one (21) years of age;
      • Checking the box to opt-in to Sponsor’s marketing database; and
      • Checking the box to verify that the entrant has read these Official Rules.

      Contest participants must validate their email address by clicking “confirm” when they receive an email from [email protected].

    • 4.2  Super High Roller Website Method of Entry
      During the Sweepstakes Period, visit SuperHighRoller.com and complete a Sweepstakes entry form, which requires the following information and affirmative actions from each entrant:

      • Preferred email address for contact and notification purposes;
      • First and last name;
      • Zip code;
      • Selecting all of the providers where you watch television/digitation content from the checklist provided;
      • Checking the box to verify that the entrant is at least twenty-one (21) years of age;
      • Checking the box to opt-in to Sponsor’s marketing database; and
      • Checking the box to verify that the entrant has read these Official Rules.

      Contest participants must validate their email address by clicking “confirm” when they receive an email from [email protected].

    • 4.3  Poker Central Website Method of Entry
      Beginning on April 1, 2015, and continuing throughout the duration of the Sweepstakes Period, visit PokerCentral.com and complete a Sweepstakes entry form, which requires the following information and affirmative actions from each entrant:

      • Preferred email address for contact and notification purposes;
      • First and last name;
      • Zip code;
      • Selecting all of the providers where you watch television/digitation content from the checklist provided;
      • Checking the box to verify that the entrant is at least twenty-one (21) years of age;
      • Checking the box to opt-in to Sponsor’s marketing database; and
      • Checking the box to verify that the entrant has read these Official Rules.

      Contest participants must validate their email address by clicking “confirm” when they receive an email from [email protected].

    All required fields of the onscreen registration form must be complete to receive one (1) entry into the Sweepstakes. Limit one (1) total entry per person for completing a Sweepstakes entry form during the Sweepstakes Period regardless of the method of entry used. All entries must be received by May 15, 2015, at 11:59:59 p.m. ET to be eligible.

    Sponsor is not responsible for incorrect or inaccurate transcription of entry information, computer, online or human error, technical malfunctions, any omission, interruption, defect, or any other error, including, without limitation, lost, late, incomplete, invalid, unintelligible or misdirected entries, all of which may constitute grounds for disqualification in Sponsor’s sole discretion. If a problem occurs in the entry process, the entrant is solely responsible for verifying that the entry process has been validly completed. Sponsor shall have no obligation to advise an entrant of an incomplete entry. Attempts made by an entrant to submit multiple entries or to otherwise act in violation of these Official Rules by using multiple/different email addresses, social media accounts, identities, and logins, are prohibited and all entries obtained by such an entrant may be disqualified if detected. Using an automated system to participate in the Sweepstakes or attempting to subvert the Sweepstakes entry process is also prohibited and may result in disqualification.

    In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the authorized account holder of the e-mail address associated with the entry. Authorized account holder is defined as the person assigned to an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses. Sponsor reserves the right to require entrants to show proof of being the authorized account holder. All entries become the sole and exclusive property of Sponsor and will not be acknowledged or returned. Entrant is responsible for all online charges incurred with any Internet service provider and/or wireless carrier.

  5. Winner Selection and Odds of Winning: On or about June 1, 2015, five (5) potential Grand Prize winners will be randomly selected from among all eligible entries received during the Sweepstakes Period. The drawing will be conducted under the supervision of the Sponsor at Sponsor’s location.The odds of winning a Grand Prize depend on the number of eligible entries received during the Sweepstakes Period.
  6. Winner Notification and Verification: Within twenty-four (24) hours of the random drawing, Sponsor will notify potential Grand Prize winners by telephone, email and/or mail using the information provided on his/her online registration form. A potential Grand Prize winner is not a winner of a Grand Prize unless and until the potential Grand Prize winner’s eligibility has been verified and he/she has been notified that verification is complete. Prior to being declared a Grand Prize winner, potential Grand Prize winners will, within seven (7) days of date of notification, be required to sign and return via email/mail, an Affidavit of Eligibility/Release of Liability, assignment of rights (as applicable) prepared by the Sponsor (“Release”), which, among other things: (i) confirms compliance with these Official Rules; and (ii) confirms the release, representation and warranties and indemnification specified herein. A potential Grand Prize winner’s failure to timely return the Release shall result in his/her forfeiture of the Grand Prize. If the Grand Prize notification or Release is returned as undeliverable or is not returned within seven (7) days, Grand Prize will be forfeited and an alternate may be selected and contacted. Sponsor retains the right to repeat this process until an alternate potential Grand Prize winner complies with the verification of eligibility requirements.ALL POTENTIAL GRAND PRIZE WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR. SPONSOR’S DECISIONS AS TO THE ADMINISTRATION AND OPERATION OF THE SWEEPSTAKES, ANY CHANGES TO THESE OFFICIAL RULES, AND THE SELECTION OF POTENTIAL WINNERS IS FINAL AND BINDING ON EACH ENTRANT IN ALL MATTERS RELATED TO THE SWEEPSTAKES.
  7. Grand Prize and Approximate Retail Value (“ARV”): Subject to verification of eligibility and compliance with these Official Rules, five (5) Grand Prize winners will receive a trip for two (2) to Las Vegas, Nevada for the 2015 Super High Roller Bowl Tournament to be held in July 2015 (the “Grand Prize”). The Grand Prize will include: (i) roundtrip coach class airfare for the Grand Prize winner and one (1) eligible travel companion (travel companion must be twenty-one (21) years of age or older) from the major U.S. airport nearest the winner’s hometown (as determined by Sponsor in its sole discretion) to McCarran International Airport in Las Vegas, Nevada; (ii) hotel accommodations (single standard room, double occupancy, room and tax only) for two (2) at ARIA Resort & Casino during the Super High Roller Bowl Tournament; (iii) five thousand dollars ($5,000) in cash; and (iv) two (2) tickets to the televised “Final Table” of the Super High Roller Bowl Tournament and an opportunity to be interviewed by Poker Central broadcasting staff during the course of the televised “Final Table.”The total ARV of each Grand Prize is six thousand eight hundred dollars ($6,800). The total ARV of all Grand Prizes is thirty four thousand dollars ($34,000). The ARV for the Grand Prizes is an estimate made before the Sweepstakes begins. The ARV for the Grand Prizes may vary depending upon points of departure and fare fluctuations. Sponsor reserves the right to structure travel routes and select hotels in its sole discretion. Grand Prize winners will not receive cash or any other form of compensation if actual travel costs are less than the estimate made in these Official Rules.
  8. Prize Restrictions: A Grand Prize will be awarded only if the potential Grand Prize winner fully complies with these Official Rules. All Grand Prize details are at the sole discretion of Sponsor and any depiction of the Grand Prize, in Sweepstakes materials or otherwise, is for illustrative purposes only. Hotel and airfare prize components are subject to availability, and Sponsor reserves the right to change any component in its sole discretion if such component is unavailable. No transfer, refund, cash redemption, substitution, replacement or cash equivalent for the Grand Prize or any Grand Prize component will be made, except that Sponsor at its sole discretion may substitute a Grand Prize (or component thereof) of equal or greater value for any reason. All federal, state, provincial and local taxes, and all costs and expenses related to the acceptance and use of the Grand Prize not specified herein as being provided, are the sole responsibility of the Grand Prize winners. Any required tax reporting forms will be furnished to the appropriate authorities.In the event that the Sweepstakes is cancelled or postponed by Sponsor for any reason whatsoever, the ARV of the Grand Prizes will be awarded to the extent required by law. Sponsor shall have no responsibility or obligation to a Grand Prize winner or a potential Grand Prize winner who is unable or unavailable to, or who does not for any reason, accept or utilize the Grand Prize. In the event of non-compliance with these Official Rules, or if a Grand Prize is unclaimed, that Grand Prize will be forfeit. A forfeited Grand Prize may be awarded to an alternate winner, in Sponsor’s sole discretion.

    By participating in this Sweepstakes or accepting a Grand Prize, entrants further acknowledge and agree to the following Grand Prize restrictions:

    • 8.1.Air Transportation
      All travel is subject to availability. All travel arrangements are to be administered by Sponsor or its designees. Once flight arrangements have been confirmed, no changes will be allowed except by Sponsor or its designees. Travel must originate and end at the same airport, except as otherwise provided by these Official Rules. A Grand Prize winner and their travel companion must travel on the same itineraries including the same departure date, destination and return date, and must possess all required travel documents, including visas and valid passports, if applicable. Airfare may not include government taxes, passenger facility charges or September 11th security fees. Airline tickets are non-refundable/non-transferable and are not eligible for upgrades or frequent flyer miles. Other travel restrictions may apply. All airline tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes. No stopovers are permitted on tickets issued as part of the Grand Prize; if a stopover occurs, the Grand Prize will terminate and full fare will be charged from the stopover point for the remaining trip segments, including the return. In the event a Grand Prize winner’s residence is located in Las Vegas, Nevada, the airfare portion of the Grand Prize will be forfeited in its entirety and no additional Grand Prize element will be substituted, except in Sponsor’s sole discretion.
    • 8.2.Hotel Accommodations
      Once hotel accommodations have been confirmed, no changes will be allowed except by Sponsor or its designees. Hotel accommodations are subject to additional restrictions and requirements as set forth in the hotel agreement. All incidentals not mentioned within the Grand Prize details, including, without limitation, luggage fees, service charges or facility charges, personal charges, damage to hotel room, security fees, gratuities, taxes or other expenses, are the sole responsibility of each Grand Prize winner and his/her travel companion.
    • 8.3.Incidental Expenses
      No changes will be made to the travel details once any element(s) of the travel arrangements have been booked, except in Sponsor’s sole discretion. All other expenses and incidental travel costs not expressly stated in the Official Rules, including but not limited to, meals, incidentals, passenger tariffs or duties, airline fees, surcharges, airport fees, luggage fees, service charges or facility charges, personal charges, damage to hotel room, security fees, gratuities, taxes or other expenses, including any transportation not mentioned within such Grand Prize description, including without, limitation transportation to and from airports, are the sole responsibility of each Grand Prize winner and their travel companions. Grand Prize winners and their travel companions are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance.
    • 8.4.Conduct
      Grand Prize winners and their travel companions must follow all instructions of Sponsor or its designees relative to the Grand Prize and any element thereof. In the event a Grand Prize winner or his/her travel companion engages in behavior that, as determined by Sponsor in its sole discretion, is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the Grand Prize or other applicable experience early, in whole or in part, and send the Grand Prize winner and his/her travel companion home with no further compensation. In such event, Grand Prize winner may also be required to reimburse the Sponsor for the ARV of the Prize.

    THE GRAND PRIZES ARE AWARDED AS IS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS MAY NOT ALLOW (OR MAY LIMIT) DISCLAIMERS OF CERTAIN WARRANTIES, IN WHICH CASE THE FOREGOING DISCLAIMERS WILL BE ENFORCED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

  9. General Conditions: The Sweepstakes is subject to applicable federal, state, provincial, municipal, territorial, and local laws and regulations. Winning a Grand Prize is contingent upon accepting and fulfilling all requirements of these Official Rules. Sponsor reserves the right without liability to disqualify any entrant or cancel, suspend, modify and/or terminate the Sweepstakes, or any part of it, for any reason, including, but not limited to, insufficient entries, any printing, seeding, typographical, technical errors, human or otherwise, suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes or any other factor beyond Sponsor’s reasonable control, as determined by Sponsor in its sole discretion. Sponsor also reserves the right, in its sole discretion, to disqualify any individual determined to be in violation of these Official Rules or determined to have acted in an otherwise disruptive or dishonest manner. Potential Grand Prize winners understand and agree that, as a condition of winning the Grand Prize, he/she may be subject to a background check in the sole discretion of Sponsor. Based on the results of the background check, at the discretion of the Sponsor, a potential Grand Prize winner may be disqualified: (a) if charged with or convicted of a felony or misdemeanor; (b) if Sponsor determines, in its sole discretion, that such individual may reflect unfavorably on the Sweepstakes or Sponsor; (c) if he/she is not eligible to receive the Grand Prize based on the eligibility requirements set forth in these Official Rules. The Released Parties (as defined in Section 10) are not responsible for lost, late, incomplete, damaged, stolen or misdirected entries or social media posts; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or submission of entry will not be deemed proof of receipt by Sponsor. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes if it is not capable of running as planned, including, but not limited to, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures or any other problems and award the Grand Prize from among all eligible entries received prior to cancellation, if any.WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

    The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof.

  10. Release and Limitations of Liability: By participating in the Sweepstakes, you agree to release, indemnify and hold harmless Sponsor, Facebook/Google/Twitter Group, and each of their parent companies, affiliates, subsidiaries, franchisees, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, website providers, web masters, and any and all other companies associated with the design or execution of the Sweepstakes, as well as their respective officers, directors, employees, representatives and agents (the “Released Parties”) from any and all liability for any: (i) act, failure to act, delay, or error relating to the transmitting or processing of entries or social media posts; (ii) lost, stolen, delayed, damaged or misdirected entries or social media posts or for any failure of the website during the Sweepstakes Period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any website/application, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the Sweepstakes; (iii) any incorrect or inaccurate information, whether caused by entrant, printing errors or by any of the equipment, hardware, software or programming associated or used with the Sweepstakes; (iv) any conditions caused by events that may cause the Sweepstakes to be disrupted or corrupted; (v) any losses or damages of any kind resulting directly or indirectly from acceptance, use, or misuse of the Grand Prize awarded to entrant in the Sweepstakes (including any/all use of the Grand Prize) or from entrant’s participation in the Sweepstakes; (vi) any printing or typographical errors in any materials relating to the Sweepstakes; or (vii) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of Grand Prize.
  11. Disputes, Governing Law and Venue: THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEVADA, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN LAS VEGAS, NEVADA IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEVADA. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED NEVADA IN THE CITY OF LAS VEGAS. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. EXCEPT WHERE PROHIBITED, YOU AGREE THAT ANY AND ALL DISPUTES, CLAIMS AND/OR CAUSES OF ACTION ARISING OUT OF, OR CONNECTED WITH THE SWEEPSTAKES OR ANY PRIZE AWARD SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.
  12. Publicity Release and Use of Personal Information: EXCEPT WHERE PROHIBITED BY LAW, BY PARTICIPATING IN THIS SWEEPSTAKES OR ACCEPTING THE GRAND PRIZE, YOU GRANT TO SPONSOR (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR), AND THOSE ACTING PURSUANT TO THEIR AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, EACH WINNER’S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, ENTRY, FOOTAGE AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION.By submitting an entry, entrants will also be required to opt-in to Sponsor’s marketing database. Electing to receive marketing information constitutes subsequent affirmative consent, which supersedes any previous opt-out submitted to Sponsor.
